各(ge)省、自治區(qu)、直(zhi)轄(xia)市人(ren)民政府,國務院各(ge)部(bu)委、各(ge)直(zhi)屬機構:
    為加強社會信用體系建設,深入推(tui)進“放管服”改革,進一步(bu)發揮(hui)信用在創新監管機制、提(ti)高監管能(neng)力(li)和水(shui)平方面的基(ji)礎性(xing)作用,更(geng)好激(ji)發市場主體活力(li),推(tui)動高質量發展,經國務院同意,現(xian)提(ti)出如下意見。
    一、總(zong)體要求
    以(yi)習近平(ping)新時代中(zhong)(zhong)國特色社會(hui)主義思(si)想(xiang)為(wei)指導,深入貫徹落實黨的(de)十九(jiu)大和(he)十九(jiu)屆二(er)中(zhong)(zhong)、三中(zhong)(zhong)全(quan)會(hui)精神,按照依法依規(gui)、改革創(chuang)新、協(xie)同共治的(de)基(ji)本原則(ze),以(yi)加強信用監(jian)(jian)管(guan)為(wei)著力點,創(chuang)新監(jian)(jian)管(guan)理念、監(jian)(jian)管(guan)制度和(he)監(jian)(jian)管(guan)方式,建立健全(quan)貫穿市場主體全(quan)生命周期,銜接事前、事中(zhong)(zhong)、事后全(quan)監(jian)(jian)管(guan)環節的(de)新型監(jian)(jian)管(guan)機(ji)制,不斷(duan)提升監(jian)(jian)管(guan)能力和(he)水平(ping),進(jin)一(yi)步規(gui)范市場秩序,優(you)化營商環境,推(tui)動高(gao)質(zhi)量發(fa)展。
    二、創新事前環(huan)節信用監管
    (一)建(jian)立健(jian)全信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)制度(du)。在(zai)辦理(li)適用(yong)(yong)信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)制的行(xing)(xing)(xing)政(zheng)(zheng)許可事項時,申(shen)(shen)請人(ren)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)符合審批條件并提交有(you)關材料(liao)的,應予即時辦理(li)。申(shen)(shen)請人(ren)信(xin)用(yong)(yong)狀況較好(hao)、部(bu)分(fen)(fen)申(shen)(shen)報(bao)材料(liao)不齊備但書(shu)面承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)在(zai)規定期限內提供的,應先行(xing)(xing)(xing)受(shou)理(li),加快辦理(li)進度(du)。書(shu)面承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)履約(yue)(yue)情(qing)況記入信(xin)用(yong)(yong)記錄,作為事中、事后監管的重(zhong)要依據,對不履約(yue)(yue)的申(shen)(shen)請人(ren),視(shi)情(qing)節(jie)實施懲戒。要加快梳(shu)理(li)可開展(zhan)信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)的行(xing)(xing)(xing)政(zheng)(zheng)許可事項,制定格(ge)式規范的信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)書(shu),并依托各級信(xin)用(yong)(yong)門戶網(wang)站向(xiang)社(she)會(hui)公(gong)開。鼓勵(li)市場主(zhu)體主(zhu)動向(xiang)社(she)會(hui)作出信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)。支(zhi)持行(xing)(xing)(xing)業(ye)協(xie)會(hui)商會(hui)建(jian)立健(jian)全行(xing)(xing)(xing)業(ye)內信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)制度(du),加強行(xing)(xing)(xing)業(ye)自律。(各地區(qu)各部(bu)門按職責(ze)分(fen)(fen)別負責(ze))
    (二)探索(suo)開展經(jing)營者準入(ru)前誠(cheng)信(xin)(xin)教育(yu)。充(chong)分利用(yong)各級各類政(zheng)務服務窗(chuang)口(kou),廣泛(fan)開展市場(chang)(chang)主(zhu)體(ti)守法(fa)(fa)誠(cheng)信(xin)(xin)教育(yu)。為(wei)市場(chang)(chang)主(zhu)體(ti)辦理注冊、審批、備案(an)等相關業務時(shi),適時(shi)開展標準化、規范化、便捷化的(de)(de)法(fa)(fa)律知識和信(xin)(xin)用(yong)知識教育(yu),提高(gao)經(jing)營者依法(fa)(fa)誠(cheng)信(xin)(xin)經(jing)營意識。開展誠(cheng)信(xin)(xin)教育(yu)不得(de)收費(fei),也(ye)不得(de)作為(wei)市場(chang)(chang)準入(ru)的(de)(de)必要條件。(各地區各部門(men)按職責(ze)分別負責(ze))
    (三)積極拓展(zhan)(zhan)信用(yong)報(bao)(bao)告(gao)(gao)應用(yong)。鼓(gu)勵(li)各(ge)類市場主體在生產經(jing)營活動中(zhong)(zhong)更廣泛、主動地(di)應用(yong)信用(yong)報(bao)(bao)告(gao)(gao)。在政府采購、招(zhao)標(biao)投標(biao)、行政審(shen)批、市場準(zhun)入、資質(zhi)審(shen)核等事(shi)項中(zhong)(zhong),充分發揮公共信用(yong)服務(wu)機(ji)(ji)構(gou)和第(di)三方(fang)信用(yong)服務(wu)機(ji)(ji)構(gou)出具的(de)信用(yong)報(bao)(bao)告(gao)(gao)作用(yong)。探(tan)索建立全國(guo)統(tong)一的(de)信用(yong)報(bao)(bao)告(gao)(gao)標(biao)準(zhun),推動信用(yong)報(bao)(bao)告(gao)(gao)結(jie)果(guo)實(shi)現異地(di)互認。(發展(zhan)(zhan)改(gai)革委、人(ren)民銀行牽頭,各(ge)地(di)區各(ge)部門按職責分別負責)
    三(san)、加強事中環節信(xin)用監管
    (四)全面(mian)建(jian)立(li)市(shi)(shi)(shi)場(chang)主(zhu)體(ti)信(xin)(xin)(xin)(xin)用(yong)記錄。根據(ju)權責(ze)(ze)(ze)清(qing)單(dan)建(jian)立(li)信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)采(cai)集目錄,在(zai)辦理(li)注冊登記、資質審核、日(ri)常監(jian)管、公(gong)共服務等過程(cheng)中,及(ji)時、準(zhun)確、全面(mian)記錄市(shi)(shi)(shi)場(chang)主(zhu)體(ti)信(xin)(xin)(xin)(xin)用(yong)行為,特別是(shi)將失信(xin)(xin)(xin)(xin)記錄建(jian)檔留痕,做(zuo)到可查可核可溯。(各(ge)地區各(ge)部門(men)按職責(ze)(ze)(ze)分別負責(ze)(ze)(ze))完(wan)善法人(ren)和非法人(ren)組織統一(yi)社(she)會信(xin)(xin)(xin)(xin)用(yong)代碼制度,以統一(yi)社(she)會信(xin)(xin)(xin)(xin)用(yong)代碼為標(biao)識,整合(he)形(xing)成完(wan)整的市(shi)(shi)(shi)場(chang)主(zhu)體(ti)信(xin)(xin)(xin)(xin)用(yong)記錄,并通過“信(xin)(xin)(xin)(xin)用(yong)中國”網(wang)站(zhan)、國家(jia)企業信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息(xi)公(gong)示(shi)系統或中國政府網(wang)及(ji)相關部門(men)門(men)戶網(wang)站(zhan)等渠道(dao)依法依規向社(she)會公(gong)開(kai)。完(wan)成12315市(shi)(shi)(shi)場(chang)監(jian)管投(tou)訴(su)舉報熱線和信(xin)(xin)(xin)(xin)息(xi)化平臺整合(he)工作,大力開(kai)展(zhan)消費(fei)投(tou)訴(su)公(gong)示(shi),促進經營者落(luo)實消費(fei)維權主(zhu)體(ti)責(ze)(ze)(ze)任。(發展(zhan)改革委、市(shi)(shi)(shi)場(chang)監(jian)管總局負責(ze)(ze)(ze))
    (五)建立健全信(xin)用(yong)(yong)信(xin)息(xi)自愿注冊機(ji)制。鼓(gu)勵市場主體在“信(xin)用(yong)(yong)中國”網站(zhan)或(huo)其他渠(qu)道(dao)上自愿注冊資質證照、市場經(jing)營(ying)、合同履約、社會公(gong)益等(deng)信(xin)用(yong)(yong)信(xin)息(xi),并對信(xin)息(xi)真實性(xing)公(gong)開作出(chu)信(xin)用(yong)(yong)承(cheng)諾,授權網站(zhan)對相關信(xin)息(xi)進行整合、共享與應(ying)用(yong)(yong)。經(jing)驗證的(de)自愿注冊信(xin)息(xi)可作為開展信(xin)用(yong)(yong)評(ping)價和生成(cheng)信(xin)用(yong)(yong)報告的(de)重要(yao)依據。(發(fa)展改(gai)革(ge)委牽頭,各部(bu)門按職責分(fen)別負責)
    (六)深(shen)入開(kai)展(zhan)公(gong)(gong)共信(xin)(xin)(xin)用(yong)(yong)(yong)綜合(he)(he)評價(jia)(jia)。全國信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)共享平(ping)臺要加(jia)強與相(xiang)關部(bu)(bu)(bu)門(men)的(de)協同(tong)配合(he)(he),依法依規(gui)整合(he)(he)各(ge)類信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi),對市(shi)場(chang)主體開(kai)展(zhan)全覆蓋(gai)、標準化、公(gong)(gong)益性的(de)公(gong)(gong)共信(xin)(xin)(xin)用(yong)(yong)(yong)綜合(he)(he)評價(jia)(jia),定期將評價(jia)(jia)結果(guo)推送(song)至(zhi)相(xiang)關政(zheng)府部(bu)(bu)(bu)門(men)、金融機構、行(xing)業協會商會參考使用(yong)(yong)(yong),并依照有(you)關規(gui)定向社(she)會公(gong)(gong)開(kai)。推動(dong)相(xiang)關部(bu)(bu)(bu)門(men)利用(yong)(yong)(yong)公(gong)(gong)共信(xin)(xin)(xin)用(yong)(yong)(yong)綜合(he)(he)評價(jia)(jia)結果(guo),結合(he)(he)部(bu)(bu)(bu)門(men)行(xing)業管(guan)理數據,建立行(xing)業信(xin)(xin)(xin)用(yong)(yong)(yong)評價(jia)(jia)模型(xing),為信(xin)(xin)(xin)用(yong)(yong)(yong)監管(guan)提供更精準的(de)依據。(發展(zhan)改革委牽頭(tou),各(ge)部(bu)(bu)(bu)門(men)按職責(ze)分(fen)別負責(ze))
    (七)大(da)力推進信(xin)(xin)(xin)用(yong)分(fen)(fen)級(ji)分(fen)(fen)類監(jian)(jian)管(guan)(guan)。在充分(fen)(fen)掌握(wo)信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息、綜合(he)(he)研判(pan)信(xin)(xin)(xin)用(yong)狀況的(de)基礎上,以公共信(xin)(xin)(xin)用(yong)綜合(he)(he)評(ping)價(jia)結(jie)果、行業(ye)信(xin)(xin)(xin)用(yong)評(ping)價(jia)結(jie)果等為依(yi)據(ju),對(dui)(dui)監(jian)(jian)管(guan)(guan)對(dui)(dui)象進行分(fen)(fen)級(ji)分(fen)(fen)類,根(gen)據(ju)信(xin)(xin)(xin)用(yong)等級(ji)高低采取差異化(hua)的(de)監(jian)(jian)管(guan)(guan)措施。“雙隨機、一公開”監(jian)(jian)管(guan)(guan)要與(yu)信(xin)(xin)(xin)用(yong)等級(ji)相(xiang)結(jie)合(he)(he),對(dui)(dui)信(xin)(xin)(xin)用(yong)較好、風險(xian)(xian)較低的(de)市場主(zhu)體,可合(he)(he)理降(jiang)低抽查(cha)比(bi)例和(he)頻(pin)次(ci),減少對(dui)(dui)正(zheng)常生產經(jing)營的(de)影響;對(dui)(dui)信(xin)(xin)(xin)用(yong)風險(xian)(xian)一般的(de)市場主(zhu)體,按常規比(bi)例和(he)頻(pin)次(ci)抽查(cha);對(dui)(dui)違法(fa)失(shi)信(xin)(xin)(xin)、風險(xian)(xian)較高的(de)市場主(zhu)體,適(shi)當提高抽查(cha)比(bi)例和(he)頻(pin)次(ci),依(yi)法(fa)依(yi)規實(shi)行嚴(yan)管(guan)(guan)和(he)懲戒。(各地區各部門按職責(ze)分(fen)(fen)別負責(ze))
    四(si)、完(wan)善事(shi)后環節信用監管(guan)
    (八)健全失(shi)信(xin)聯(lian)合(he)懲戒(jie)對(dui)(dui)(dui)(dui)象認(ren)定(ding)(ding)機制。有關(guan)(guan)部(bu)門(men)依(yi)據(ju)在事前、事中監(jian)(jian)管(guan)環節(jie)獲取并認(ren)定(ding)(ding)的失(shi)信(xin)記錄,依(yi)法依(yi)規建立(li)健全失(shi)信(xin)聯(lian)合(he)懲戒(jie)對(dui)(dui)(dui)(dui)象名單制度(du)。以相關(guan)(guan)司(si)法裁(cai)判、行政(zheng)處罰(fa)、行政(zheng)強制等處理(li)結果為(wei)(wei)依(yi)據(ju),按程(cheng)(cheng)序將涉及(ji)性(xing)質(zhi)惡劣、情節(jie)嚴(yan)重、社會危害較大的違法失(shi)信(xin)行為(wei)(wei)的市場主(zhu)體納入失(shi)信(xin)聯(lian)合(he)懲戒(jie)對(dui)(dui)(dui)(dui)象名單。加快完善相關(guan)(guan)管(guan)理(li)辦法,明確認(ren)定(ding)(ding)依(yi)據(ju)、標準(zhun)、程(cheng)(cheng)序、異議(yi)申訴和退出機制。制定(ding)(ding)管(guan)理(li)辦法要充分征求(qiu)社會公眾意見(jian),出臺的標準(zhun)及(ji)其具(ju)體認(ren)定(ding)(ding)程(cheng)(cheng)序以適當方(fang)式向社會公開(kai)。支持有關(guan)(guan)部(bu)門(men)根據(ju)監(jian)(jian)管(guan)需(xu)要建立(li)重點(dian)關(guan)(guan)注(zhu)對(dui)(dui)(dui)(dui)象名單制度(du),對(dui)(dui)(dui)(dui)存(cun)在失(shi)信(xin)行為(wei)(wei)但嚴(yan)重程(cheng)(cheng)度(du)尚未達到失(shi)信(xin)聯(lian)合(he)懲戒(jie)對(dui)(dui)(dui)(dui)象認(ren)定(ding)(ding)標準(zhun)的市場主(zhu)體,可實施與其失(shi)信(xin)程(cheng)(cheng)度(du)相對(dui)(dui)(dui)(dui)應的嚴(yan)格監(jian)(jian)管(guan)措施。(各部(bu)門(men)按職責分別負責)
    (九(jiu))督促失信(xin)(xin)市場主(zhu)(zhu)體(ti)限期整(zheng)改(gai)。失信(xin)(xin)市場主(zhu)(zhu)體(ti)應當在規定期限內認(ren)真(zhen)整(zheng)改(gai),整(zheng)改(gai)不(bu)到位的,按(an)照“誰認(ren)定、誰約(yue)(yue)談”的原則(ze),由認(ren)定部門(men)依法依規啟動提示約(yue)(yue)談或警示約(yue)(yue)談程序(xu),督促失信(xin)(xin)市場主(zhu)(zhu)體(ti)履行相關義務(wu)、消除不(bu)良影響。約(yue)(yue)談記錄記入(ru)失信(xin)(xin)市場主(zhu)(zhu)體(ti)信(xin)(xin)用(yong)記錄,統一歸(gui)集后納入(ru)全國信(xin)(xin)用(yong)信(xin)(xin)息共享平臺。大(da)力推進(jin)重點領域失信(xin)(xin)問題(ti)專項(xiang)治(zhi)理,采取(qu)有(you)力有(you)效措施加快推進(jin)整(zheng)改(gai)。(各部門(men)按(an)職責分別負責)
    (十)深入開展失(shi)信(xin)聯(lian)合(he)(he)懲(cheng)(cheng)(cheng)戒(jie)。加快構建跨地(di)區(qu)、跨行(xing)(xing)業(ye)(ye)、跨領域的失(shi)信(xin)聯(lian)合(he)(he)懲(cheng)(cheng)(cheng)戒(jie)機制,從根本上解決(jue)失(shi)信(xin)行(xing)(xing)為反復出(chu)現、易地(di)出(chu)現的問題。依法依規(gui)建立聯(lian)合(he)(he)懲(cheng)(cheng)(cheng)戒(jie)措(cuo)(cuo)施清單,動態更新并向(xiang)社會公(gong)開,形成行(xing)(xing)政性(xing)、市場性(xing)和行(xing)(xing)業(ye)(ye)性(xing)等(deng)懲(cheng)(cheng)(cheng)戒(jie)措(cuo)(cuo)施多(duo)管齊下(xia),社會力量廣泛(fan)參與的失(shi)信(xin)聯(lian)合(he)(he)懲(cheng)(cheng)(cheng)戒(jie)大格(ge)局。重點實施懲(cheng)(cheng)(cheng)戒(jie)力度大、監管效(xiao)果好的失(shi)信(xin)懲(cheng)(cheng)(cheng)戒(jie)措(cuo)(cuo)施,包括(kuo)依法依規(gui)限(xian)制失(shi)信(xin)聯(lian)合(he)(he)懲(cheng)(cheng)(cheng)戒(jie)對(dui)象(xiang)股票發行(xing)(xing)、招標投標、申請財(cai)政性(xing)資金項目、享(xiang)受稅(shui)收優惠等(deng)行(xing)(xing)政性(xing)懲(cheng)(cheng)(cheng)戒(jie)措(cuo)(cuo)施,限(xian)制獲(huo)得授(shou)信(xin)、乘坐飛機、乘坐高(gao)等(deng)級列(lie)車和席次等(deng)市場性(xing)懲(cheng)(cheng)(cheng)戒(jie)措(cuo)(cuo)施,以(yi)及通報(bao)批評(ping)、公(gong)開譴(qian)責(ze)(ze)等(deng)行(xing)(xing)業(ye)(ye)性(xing)懲(cheng)(cheng)(cheng)戒(jie)措(cuo)(cuo)施。(發展改革委(wei)牽頭,各(ge)地(di)區(qu)各(ge)部門按職(zhi)責(ze)(ze)分別負責(ze)(ze))
    (十(shi)一(yi))堅(jian)決依(yi)法依(yi)規(gui)實施市場(chang)和(he)行(xing)業禁入(ru)措施。以食品(pin)藥品(pin)、生態環境、工(gong)程質(zhi)量、安全(quan)生產(chan)、養老(lao)托幼(you)、城市運行(xing)安全(quan)等與人民(min)群眾(zhong)生命財產(chan)安全(quan)直(zhi)接相關的領域為(wei)重點,實施嚴格監(jian)管,加大懲戒(jie)力度。對拒不履行(xing)司法裁判或行(xing)政處罰決定、屢犯不改、造(zao)成重大損(sun)失的市場(chang)主體及(ji)其相關責任人,堅(jian)決依(yi)法依(yi)規(gui)在(zai)一(yi)定期限內實施市場(chang)和(he)行(xing)業禁入(ru)措施,直(zhi)至永遠逐出市場(chang)。(發(fa)展(zhan)改革委牽頭,各地區各部(bu)門按職責分別負責)
    (十二)依法(fa)追究違(wei)法(fa)失(shi)信(xin)責任。建立健全責任追究機制,對被(bei)列(lie)入失(shi)信(xin)聯合懲(cheng)戒對象名單的(de)市(shi)場主體,依法(fa)依規(gui)對其法(fa)定代(dai)表人(ren)(ren)或主要負責人(ren)(ren)、實際控制人(ren)(ren)進行(xing)失(shi)信(xin)懲(cheng)戒,并將(jiang)相關失(shi)信(xin)行(xing)為(wei)記(ji)入其個人(ren)(ren)信(xin)用記(ji)錄。機關事(shi)業(ye)單位(wei)(wei)、國有企業(ye)出現(xian)違(wei)法(fa)失(shi)信(xin)行(xing)為(wei)的(de),要通報上級主管單位(wei)(wei)和(he)審計部門;工作人(ren)(ren)員出現(xian)違(wei)法(fa)失(shi)信(xin)行(xing)為(wei)的(de),要通報所在單位(wei)(wei)及相關紀檢監察(cha)、組織人(ren)(ren)事(shi)部門。(各(ge)地(di)區各(ge)部門按職(zhi)責分別負責)
    (十三)探索建立信(xin)(xin)(xin)用(yong)(yong)(yong)修(xiu)復(fu)機制。失(shi)信(xin)(xin)(xin)市場主體在規定期限內糾正失(shi)信(xin)(xin)(xin)行為(wei)、消除不良影(ying)響(xiang)的,可通過作(zuo)出(chu)信(xin)(xin)(xin)用(yong)(yong)(yong)承諾、完(wan)成信(xin)(xin)(xin)用(yong)(yong)(yong)整改、通過信(xin)(xin)(xin)用(yong)(yong)(yong)核查(cha)、接(jie)受(shou)專題培訓(xun)、提(ti)交(jiao)信(xin)(xin)(xin)用(yong)(yong)(yong)報告、參(can)加公益慈(ci)善活動(dong)等(deng)(deng)方式開展信(xin)(xin)(xin)用(yong)(yong)(yong)修(xiu)復(fu)。修(xiu)復(fu)完(wan)成后,各地區各部門要(yao)按程(cheng)序(xu)及時停止(zhi)公示其失(shi)信(xin)(xin)(xin)記錄,終(zhong)止(zhi)實施(shi)聯合懲戒措施(shi)。加快建立完(wan)善協同聯動(dong)、一(yi)網(wang)通辦機制,為(wei)失(shi)信(xin)(xin)(xin)市場主體提(ti)供(gong)高效(xiao)便捷的信(xin)(xin)(xin)用(yong)(yong)(yong)修(xiu)復(fu)服務。鼓勵符(fu)合條(tiao)件(jian)的第(di)三方信(xin)(xin)(xin)用(yong)(yong)(yong)服務機構向失(shi)信(xin)(xin)(xin)市場主體提(ti)供(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)報告、信(xin)(xin)(xin)用(yong)(yong)(yong)管理咨詢(xun)等(deng)(deng)服務。(發展改革委牽(qian)頭,各地區各部門按職責分別負(fu)責)
    五、強化信用監(jian)管(guan)的支撐(cheng)保障

    (十(shi)五)大力推(tui)進信用(yong)監管信息(xi)公(gong)開(kai)公(gong)示。在(zai)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)許可、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)處罰信息(xi)集中公(gong)示基礎上,依托(tuo)“信用(yong)中國”網(wang)站、中國政(zheng)(zheng)(zheng)(zheng)府網(wang)或其(qi)他(ta)渠道(dao),進一步研(yan)究(jiu)推(tui)動行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)強制、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)確認、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)征收、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)給付、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)裁(cai)決、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)補(bu)償(chang)、行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)獎勵和行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)監督檢查(cha)等其(qi)他(ta)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)行(xing)(xing)(xing)為信息(xi)7個工作(zuo)日內上網(wang)公(gong)開(kai),推(tui)動在(zai)司(si)法裁(cai)判和執行(xing)(xing)(xing)活動中應(ying)當公(gong)開(kai)的失(shi)(shi)信被執行(xing)(xing)(xing)人、虛假訴訟(song)失(shi)(shi)信人相(xiang)關信息(xi)通過適(shi)當渠道(dao)公(gong)開(kai),做到“應(ying)公(gong)開(kai)、盡公(gong)開(kai)”。(各(ge)地(di)區各(ge)部門按職責(ze)分別負責(ze))
    (十六)充(chong)分(fen)發(fa)(fa)揮“互(hu)(hu)(hu)聯(lian)(lian)網(wang)(wang)+”、大(da)數(shu)(shu)據對(dui)信(xin)(xin)用(yong)監(jian)管(guan)(guan)(guan)的(de)支撐作用(yong)。依(yi)托國(guo)家(jia)“互(hu)(hu)(hu)聯(lian)(lian)網(wang)(wang)+監(jian)管(guan)(guan)(guan)”等(deng)(deng)系(xi)統,有(you)效整合(he)(he)公(gong)共信(xin)(xin)用(yong)信(xin)(xin)息、市(shi)場信(xin)(xin)用(yong)信(xin)(xin)息、投(tou)訴舉報信(xin)(xin)息和(he)互(hu)(hu)(hu)聯(lian)(lian)網(wang)(wang)及(ji)(ji)第三(san)方相關(guan)信(xin)(xin)息,充(chong)分(fen)運(yun)用(yong)大(da)數(shu)(shu)據、人工智能等(deng)(deng)新一(yi)代信(xin)(xin)息技術,實(shi)(shi)現(xian)(xian)信(xin)(xin)用(yong)監(jian)管(guan)(guan)(guan)數(shu)(shu)據可(ke)比對(dui)、過(guo)程可(ke)追溯、問題(ti)可(ke)監(jian)測。鼓勵各地區各部(bu)門結合(he)(he)實(shi)(shi)際,依(yi)法(fa)依(yi)規(gui)與大(da)數(shu)(shu)據機(ji)構合(he)(he)作開(kai)發(fa)(fa)信(xin)(xin)用(yong)信(xin)(xin)息,及(ji)(ji)時動(dong)態掌握市(shi)場主(zhu)體經(jing)營情況(kuang)及(ji)(ji)其規(gui)律特征。充(chong)分(fen)利用(yong)國(guo)家(jia)“互(hu)(hu)(hu)聯(lian)(lian)網(wang)(wang)+監(jian)管(guan)(guan)(guan)”等(deng)(deng)系(xi)統建(jian)立(li)風(feng)險預判預警機(ji)制,及(ji)(ji)早發(fa)(fa)現(xian)(xian)防(fang)范(fan)苗頭(tou)性和(he)跨(kua)行業跨(kua)區域風(feng)險。運(yun)用(yong)大(da)數(shu)(shu)據主(zhu)動(dong)發(fa)(fa)現(xian)(xian)和(he)識別違(wei)法(fa)違(wei)規(gui)線索,有(you)效防(fang)范(fan)危害公(gong)共利益和(he)群眾生命財產安全的(de)違(wei)法(fa)違(wei)規(gui)行為。鼓勵通過(guo)物(wu)聯(lian)(lian)網(wang)(wang)、視聯(lian)(lian)網(wang)(wang)等(deng)(deng)非接觸(chu)式監(jian)管(guan)(guan)(guan)方式提升執法(fa)監(jian)管(guan)(guan)(guan)效率,實(shi)(shi)現(xian)(xian)監(jian)管(guan)(guan)(guan)規(gui)范(fan)化、精準化、智能化,減(jian)少(shao)人為因素(su),實(shi)(shi)現(xian)(xian)公(gong)正監(jian)管(guan)(guan)(guan),杜絕隨意檢查、多(duo)(duo)頭(tou)監(jian)管(guan)(guan)(guan)等(deng)(deng)問題(ti),實(shi)(shi)現(xian)(xian)“進一(yi)次門、查多(duo)(duo)項事(shi)”,減(jian)少(shao)對(dui)監(jian)管(guan)(guan)(guan)對(dui)象(xiang)的(de)擾動(dong)。(國(guo)務院辦公(gong)廳(ting)、發(fa)(fa)展改革委(wei)、市(shi)場監(jian)管(guan)(guan)(guan)總局(ju)牽頭(tou),各部(bu)門按職責(ze)分(fen)別負(fu)責(ze))
    (十七)切(qie)實加大信(xin)用信(xin)息(xi)安(an)全和市(shi)場(chang)主(zhu)體權益保護(hu)(hu)力度。嚴肅查處違規泄(xie)露、篡改信(xin)用信(xin)息(xi)或利用信(xin)用信(xin)息(xi)謀私等(deng)行為。加強信(xin)用信(xin)息(xi)安(an)全基礎設(she)施(shi)和安(an)全防護(hu)(hu)能力建(jian)設(she)。建(jian)立健全信(xin)用信(xin)息(xi)異議(yi)投(tou)訴(su)制(zhi)度,對(dui)(dui)市(shi)場(chang)主(zhu)體提出異議(yi)的信(xin)息(xi),信(xin)息(xi)提供和采(cai)(cai)集單位(wei)要(yao)(yao)盡快核實并反饋結果,經(jing)核實有誤(wu)的信(xin)息(xi)要(yao)(yao)及時予以更(geng)正或撤銷。因錯誤(wu)認(ren)定失(shi)信(xin)聯(lian)合懲(cheng)戒對(dui)(dui)象名單、錯誤(wu)采(cai)(cai)取失(shi)信(xin)聯(lian)合懲(cheng)戒措施(shi)損害市(shi)場(chang)主(zhu)體合法權益的,有關部(bu)門和單位(wei)要(yao)(yao)積(ji)極(ji)采(cai)(cai)取措施(shi)消除不(bu)良影響。(各地區各部(bu)門按職責分別(bie)負(fu)責)
 
(十八)積極引導行(xing)業(ye)(ye)組織(zhi)和信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)服務機構(gou)協(xie)同監管(guan)。支持有關(guan)部門(men)授(shou)權(quan)的(de)行(xing)業(ye)(ye)協(xie)會(hui)商會(hui)協(xie)助開(kai)展行(xing)業(ye)(ye)信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)建(jian)設和信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)監管(guan),鼓(gu)勵行(xing)業(ye)(ye)協(xie)會(hui)商會(hui)建(jian)立(li)會(hui)員(yuan)信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)記(ji)錄,開(kai)展信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)承(cheng)諾、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)培訓、誠(cheng)信(xin)(xin)宣傳、誠(cheng)信(xin)(xin)倡(chang)議等,將誠(cheng)信(xin)(xin)作(zuo)(zuo)為(wei)行(xing)規行(xing)約重要內容,引導本行(xing)業(ye)(ye)增強依法(fa)誠(cheng)信(xin)(xin)經營意識。推動征信(xin)(xin)、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)評級、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)保(bao)險、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)擔保(bao)、履約擔保(bao)、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)管(guan)理咨(zi)詢及(ji)培訓等信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)服務發(fa)展,切實發(fa)揮第(di)(di)三(san)(san)方信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)服務機構(gou)在(zai)(zai)信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)息采集、加(jia)工、應用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)等方面(mian)的(de)專(zhuan)業(ye)(ye)作(zuo)(zuo)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)。鼓(gu)勵相關(guan)部門(men)與第(di)(di)三(san)(san)方信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)服務機構(gou)在(zai)(zai)信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)記(ji)錄歸(gui)集、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)信(xin)(xin)息共(gong)享、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)大(da)數(shu)據分析、信(xin)(xin)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)風(feng)險預警(jing)、失信(xin)(xin)案例核查、失信(xin)(xin)行(xing)為(wei)跟蹤監測等方面(mian)開(kai)展合作(zuo)(zuo)。(發(fa)展改革委(wei)、民政部、人民銀行(xing)按職責(ze)分別負責(ze))
    六、加強(qiang)信(xin)用監管的(de)組織實(shi)施
    (十九)加強(qiang)組(zu)織(zhi)領導(dao)。各(ge)地(di)區各(ge)部門要(yao)把(ba)構建以信(xin)用(yong)為(wei)基礎的新型監(jian)管(guan)機(ji)制作(zuo)為(wei)深入推進“放管(guan)服”改革的重要(yao)舉(ju)措(cuo),擺在更加突出的位置,加強(qiang)組(zu)織(zhi)領導(dao),細化責(ze)(ze)任分工,有(you)力(li)有(you)序(xu)有(you)效推動落實(shi)。完善信(xin)用(yong)監(jian)管(guan)的配套制度,并加強(qiang)與(yu)其(qi)他(ta)“放管(guan)服”改革事項的銜接。負有(you)市場監(jian)管(guan)、行業(ye)(ye)監(jian)管(guan)職(zhi)責(ze)(ze)的部門要(yao)切實(shi)承(cheng)擔(dan)行業(ye)(ye)信(xin)用(yong)建設和(he)信(xin)用(yong)監(jian)管(guan)的主(zhu)體責(ze)(ze)任,充分發揮行業(ye)(ye)組(zu)織(zhi)、第三方信(xin)用(yong)服務機(ji)構作(zuo)用(yong),為(wei)公眾監(jian)督創(chuang)造有(you)利條件,整合(he)形成全社會共同參與(yu)信(xin)用(yong)監(jian)管(guan)的強(qiang)大合(he)力(li)。(發展改革委牽頭,各(ge)地(di)區各(ge)部門按職(zhi)責(ze)(ze)分別負責(ze)(ze))
    (二(er)十)開(kai)展(zhan)試(shi)點(dian)示(shi)范(fan)。圍繞信(xin)(xin)用承諾(nuo)、信(xin)(xin)用修復、失信(xin)(xin)聯合懲戒(jie)、信(xin)(xin)用大數據開(kai)發利用等重點(dian)工作,組織開(kai)展(zhan)信(xin)(xin)用建設和信(xin)(xin)用監管試(shi)點(dian)示(shi)范(fan)。在(zai)各(ge)地(di)區(qu)各(ge)部(bu)門探(tan)索創新的基礎上,及(ji)時總結(jie)、提煉、交流(liu)開(kai)展(zhan)信(xin)(xin)用建設和信(xin)(xin)用監管的好(hao)經驗、好(hao)做(zuo)法,在(zai)更(geng)大范(fan)圍復制推廣。(發展(zhan)改革(ge)委牽頭(tou),各(ge)地(di)區(qu)各(ge)部(bu)門按職責(ze)(ze)分別負責(ze)(ze))
    (二十(shi)一)加(jia)快建章立制。推(tui)動制定社(she)會信(xin)用體系建設相關法(fa)律,加(jia)快研究出(chu)(chu)臺(tai)公(gong)共信(xin)用信(xin)息管(guan)理(li)條例、統(tong)一社(she)會信(xin)用代(dai)碼管(guan)理(li)辦法(fa)等法(fa)規(gui)。建立健全全國統(tong)一的(de)信(xin)用監(jian)管(guan)規(gui)則和標(biao)準,及(ji)時出(chu)(chu)臺(tai)相關地(di)(di)方(fang)性法(fa)規(gui)、政府(fu)規(gui)章或規(gui)范性文件,將信(xin)用監(jian)管(guan)中行之有(you)效的(de)做法(fa)上(shang)升為(wei)制度規(gui)范。抓緊制定開展(zhan)信(xin)用監(jian)管(guan)急需的(de)國家標(biao)準。(發(fa)展(zhan)改革委(wei)、司法(fa)部牽頭,各(ge)地(di)(di)區各(ge)部門按職責(ze)分(fen)別(bie)負(fu)責(ze))
    (二十二)做好宣傳解(jie)(jie)讀。各(ge)(ge)地(di)區各(ge)(ge)部門(men)要通過各(ge)(ge)種渠道(dao)和形式(shi),深入(ru)細致向市場主體做好政策宣傳解(jie)(jie)讀工作,讓(rang)經營(ying)者充分理解(jie)(jie)并積(ji)極(ji)配合以(yi)信用為(wei)基(ji)礎的新(xin)型監(jian)(jian)管措施(shi)。加強對基(ji)層和一線監(jian)(jian)管人員的指導(dao)和培訓。組(zu)織新(xin)聞媒體廣泛報道(dao),積(ji)極(ji)宣傳信用監(jian)(jian)管措施(shi)及(ji)其成效,營(ying)造良好社會氛圍。(發展改(gai)革委牽頭,各(ge)(ge)地(di)區各(ge)(ge)部門(men)按(an)職責(ze)分別負責(ze))
